Every state has procedures for evictions. Here is your guide to the eviction process when you need to get rid of a tenant that is not paying their rent.

The landlord should go through the lease with the tenant to make sure they understand the terms and conditions. I recommend having the tenant initial the bottom of every page of the lease. If there is ever any disagreement that ends up in court, the landlord can show that the tenant initialized the page that had the information that is in dispute.

The eviction process is the same in every state as listed above. The differences may come in where in some states the Sheriff will serve the eviction notice while in other states it is the Marshall's office or a private process server. In some states the tenant is given 3 days to pay in full after the court dates but given 7 days in other states.

This prevents the tenants from calling the landlord for every pity repair that they will come up with. Another item is to require the tenant to pay for any repairs that are caused by the tenant or their guests. For example if the tenant has friends over for a party and one of them breaks the window then the tenant is responsible for repairing the window.

You may be frustrated that a tenant is in your property without paying rent. Do not let this frustration lead you to evict a tenant without following the proper legal process in your state.

The only way to schedule the eviction with the Sheriff is if you have your writ of possession. The only way to get the writ of possession is if you have filed the eviction documents and had your court date already.

A lease is your best protection against disputes that might arise. If you include the key 4 issues in your lease, you can prevent most of the problems that occur when you rent a property to a tenant.
